CRIMINAL LIABILITY IS INTRODUCED FOR ILLEGAL DISTRIBUTION OF PERSONAL DATA
Criminal liability has been introduced for illegal distribution of digital information containing personal data, as well as creation and operation of information resources for its illegal storage and distribution.
The following cases shall entail a more severe punishment:
- if an act is committed in relation to information containing the personal data of minors, special categories of personal data or biometrics,
- or if a crime is committed for self-interest or by a group of persons by prior conspiracy, by means of the official position abuse, as well as causing major damage,
- or if a crime is associated with the cross-border transfer of information and (or) cross-border movement of media,
- or for a crime that entailed serious consequences or was committed by an organised group.
