FINANCIAL MARKET DEVELOPMENT: BANK OF RUSSIA’S PLANS FOR 2024-2026
The goals, directions and activities for development of the Russian financial market for 2024 and the period 2025 and 2026 have been determined. 
Among the areas are the digitalization of the financial market and development of payment infrastructure, transformation of the system of foreign trade payments and settlements. Among the tasks are development of long-term savings and investment instruments for citizens, improving corporate governance, increasing the interest of banks in lending to priority projects, developing the insurance market, and protecting against foreign currency predominance.

AI DEVELOPMENT: INSTRUCTIONS ARE GIVEN
Domestic data processing services should be created to use artificial intelligence technologies to enrich and mark up the data set. 
From 2025, implementation of AI solutions starts in the formation of a new federal project “Digital Health Services”. 
It is necessary to formulate approaches to identifying priority areas of scientific research and mechanisms for supporting the conduct of breakthrough fundamental and applied scientific research and their involving into the current instruments of state support for scientific activity.

SOME SPECIAL ECONOMIC MEASURES HAVE BEEN EXTENDED
Special economic measures in the financial sector and fuel and energy sector have been extended for another two years, until December 31, 2025. There is a talk about restrictions on transactions that entail the establishment or change of rights of ownership, use, disposal of securities, shares (contributions) in the authorised capital of Russian legal entities belonging to persons of unfriendly states, in particular, transactions with shares (stakes, contributions in the authorised capital):
- joint stocks companies included in the list of strategic enterprises and joint stocks companies;
- business companies that are manufacturers (suppliers) of equipment and services for fuel and energy companies; producers (suppliers) of thermal and electrical energy; engaged in the processing of oil, petroleum raw materials and the production of their processed products;
- credit institutions, the list of which is approved by the President of the Russian Federation.

GRANTING RUSSIAN CITIZENSHIP TO BELARUS, KAZAKHSTAN AND MOLDOVA NATIONALS: THE PROCEDURE TO BE SIMPLIFIED
Citizens of Belarus, Kazakhstan and Moldova who are permanently residing in Russia, have reached the age of 18 and have legal capacity, have the right to apply for admission to Russian citizenship. The application is submitted to the Ministry of Internal Affairs or its territorial body in the prescribed procedure and in an approved form. 
Citizens of Belarus apply without proof of permanent residence in Russia from the date of issue of the residence permit for five years; Russian language skills; knowledge of the history and basic legislation of our country. Along with the application, they submit a residence permit and a document proving their identity and citizenship.

PARENTS WILL GO ON RECEIVING CHILDCARE BENEFITS FOR CHILDREN UP TO 1.5 YEARS OLD IN CASE OF EARLY RETURN TO WORK
A law has been signed preserving the right to a monthly child care allowance for persons that returned to work (service) before a child reaches 1.5 years. Also, benefits will be paid if the mentioned persons work for another employer during the period of parental leave. 
The relevant amendments have been made to the laws on benefits for citizens with children and on compulsory social insurance in case of temporary disability and in connection with maternity.

FINANCIAL COMPANIES WERE GIVEN RECOMMENDATIONS ON TAKING INTO ACCOUNT CLIMATE RISKS
Financial institutions are invited to analyse emerging climate risks based on potential scenarios and create systems for monitoring them. Measures to reduce the adverse consequences of such threats and approaches to information disclosure are indicated. 
The Russian economy is vulnerable to climate risks due to high carbon intensity and geographic factors. Damage from natural hazards associated with climate change is increasing. This negatively impacts the profits and asset values of non-financial companies, households and other clients of financial institutions, which creates systemic threats. 
Guidance will be issued for banks in 2024 to consider climate risks when assessing capital adequacy.

EXPANDING THE GROUP OF INTERDEPENDENT PERSONS AND OTHER CHANGES IN TRANSFER PRICING FROM 2024
At the end of November 2023, numerous amendments are envisaged to be made to the Tax Code of the Russian Federation, including those in terms of transfer pricing: 
- the group of interdependent persons and international groups of companies has been expanded; 
- the criteria for recognising transactions as controllable have been clarified; 
- responsibility for transfer pricing is being tightened.

THE NOTIFICATION ABOUT THE CREATION OF SEPARATE DIVISIONS IS SENT TO THE TAX OFFICE USING A NEW FORM
The Federal Tax Service has updated the form, format, and procedure for filling out a statement about the creation of separate divisions of a Russian organisation on the territory of Russia (with the exception of branches and representative offices) and about changes to previously transmitted information. 
Now the address of a separate subdivision includes the number of the land plot. Address information is filled in in accordance with the data of the State Address Register.

RUSSIA STARTS DEVELOPING CRUISE TOURISM IN THE FAR EAST AND THE ARCTIC
A draft law aimed at developing cruise tourism in the Far East and the Arctic zone was adopted in the second reading. 
Russian cruise ships, their passengers and crew members will be exempt from border regulations when calling at ports or points located in the Arctic zone and the Far East. However, a notification about the route, passengers and crew members of the ship should be submitted to the border authorities.

ADS ON INSTAGRAM MUST COMPLY WITH LEGAL REQUIREMENTS
Operators of advertising data, advertisers, advertising distributors, and operators of advertising systems are responsible for the completeness, reliability, relevance of the information, and also for submitting information to Roskomnadzor in due time. Moreover, distribution of such advertising is allowed provided that an identifier is assigned to it. 
According to Roskomnadzor, these requirements also apply to persons distributing advertising on Instagram.

THE RIGHT TO MANAGE PULKOVO AIRPORT IS WITHDRAWN FROM FOREIGN COMPANIES

To manage Pulkovo Airport, the Government will create VSS Holding LLC, which will receive 100% of the shares of the airport management company Northern Capital Gateway, owned by the Cypriot structure Thalita Trading Limited. 

The holding participants will be 14 companies (including 11 foreign companies) that indirectly own shares in Northern Capital Gateway LLC. At the same time, the right to control the votes of foreign participants will be temporarily transferred to Northern Capital Gateway LLC and Advanced Industrial and Infrastructure Technologies-7 limited liability company. Foreign participants will be able to restore these rights subject to the conclusion of corporate agreements with other holding participants and compliance with the requirements of Russian legislation.

THE TRANSITION OF RUSSIAN IT COMPANIES TO AUTHORISATION THROUGH DOMESTIC GOVERNMENT SERVICES WILL BE POSTPONED UNTIL 2025

The State Duma adopted a law establishing a transition period for Russian IT companies until January 1, 2025, during which they will be able to use their information systems to authorise users, making preparations for the transfer of these systems under Russian control. 

In addition, the procedure for authorising users on information resources using the number of a mobile radiotelephone operator is being clarified.

Government has set a procedure for maintaining the register of hosting providers (to be kept by Roskomnadzor). 

The register to be maintained in electronic form. Information on the hosting provider to be included into the register on the basis of a notification of activities to provide processing capacity for posting information in an information system permanently connected to the Internet.

PREFERENTIAL LENDING FOR INVESTMENT PROJECTS IN THE TOURISM SECTOR: THE PROCEDURE FOR CREATING A REGISTER OF BORROWERS HAS BEEN UPDATED

Banks are reimbursed for lost income on preferential loans issued for the implementation of investment projects in the tourism sector through subsidies. The Ministry of Economic Development has approved a new procedure and criteria for inclusion in and removing from the register of borrowers. Previously, they were approved by Russian Federal Agency for Tourism.

PROCEDURE FOR TAKING DIRECT OWNERSHIP OF SHARES IN AN ECONOMICALLY SIGNIFICANT COMPANY TO BE IMPROVED

The State Duma adopted in the first reading a bill establishing a mandatory and optional procedure for entering into direct ownership of shares and interests in an economically significant organisation. 

The first is for citizens and residents of Russia. The second is for persons and entities that indirectly own shares and interests in an economically significant company. 
The procedure for filing applications for direct ownership of shares and interests in an economically significant organisation is being clarified, as well as the procedure for interaction of such companies with Rosfinmonitoring.

REPATRIATES WILL BE ABLE TO RETURN TO RUSSIA AS PART OF THE STATE PROGRAM FOR THE RESETTLEMENT OF COMPATRIOTS FROM ABROAD
As part of the state program for the resettlement of compatriots from abroad to Russia, the institution of repatriation to be established from January 1, 2024. 
Repatriates are entitled to choose a mechanism for participation in the state program - resettlement to any region with no agreement of the corresponding authority and without state support, or on general grounds. 
Confirming the knowledge of the Russian language is not necessary filing an application for participation in the state program.

MINISTRY OF FOREIGN AFFAIRS ANNOUNCED NEW RULES FOR OBTAINING RUSSIAN CITIZENSHIP

 

A more liberal procedure for registering a change of citizenship is provided: 
- the list of documents to be accepted as confirming the knowledge of the Russian language has been expanded;
- the demand to provide the consent of the second foreign parent to admit Russian citizenship to a child born in a mixed marriage is abolished;
- the list of documents that may serve as confirming the applicant’s residence in Russia as of February 6, 1992 is also expanded for the purpose of recognising a person as the Russian citizen. 
- no more need to present a residence permit abroad when filing applications for admission to or renunciation of citizenship with Russian agencies abroad.

PROCEDURE FOR SUBMITTING REPORTS ON FOREIGN ACCOUNTS BY RESIDENTS HAVE CHANGED
Federal Tax Service reports that the Government has supplemented the list of information to be provided by residents that are legal entities or individual businessmen when performing transactions on their foreign accounts as part of their obligations under foreign trade agreements.

ONLINE ADS ON FOREIGN WEB-RESOURCES (INCLUDING PROHIBITED SOCIAL NETWORKS) TO BE MARKED AS NORMAL
Roskomnadzor reminded that posting online ad for Russian audiences on foreign information resources, including Facebook and Instagram (owned by Meta, which is recognised as extremist in Russia and is prohibited in Russia), does not relieve an advertiser and advertising distributor from the obligations provided for by Russian legislation, including labelling of advertising and transfer of information on it to Roskomnadzor.

REPORT ON TRANSFERS USING FOREIGN ELECTRONIC MEANS OF PAYMENT USING NEW FORMS

 

Residents submit reports to the tax authorities on the movement of financial assets in foreign accounts (deposits) and on transfers of funds without opening a bank account using electronic means of payment provided by foreign payment service providers. 
Report forms are presented in the new wording. It is regulated to fill out reports for businesses if there are credits and (or) write-offs in the reporting quarter related to the execution of foreign trade contracts (loan agreements) registered by authorised banks.

FROM 2024, TAX BENEFITS WILL APPLY TO SERVICE COMPANIES IN THE AVIATION INDUSTRY
Amendments have been made to the Tax Code of the Russian Federation regarding the reduction of additional tax costs of service companies in the aviation industry.
In particular, a zero VAT rate has been established for transactions involving the exchange of faulty (fault-free) aircraft engines, spare parts or components of civil aircraft for similar fault-free (faulty) ones). The condition for receiving it is the submission of supporting documents to the tax authority.

Special mail services include the reception, transportation and delivery of materials containing state secrets, precious metals and stones, jewellery, Russian money and foreign currency, weapons, ammunition, military products, weapons and military equipment, explosives and explosive devices, narcotic drugs, psychotropic substances and their precursors, counterfeit-proof printed products.

RULES ARE SET FOR THE PAYMENT OF COMPENSATION TO FOREIGN HOLDINGS DURING THE PERIOD OF SUSPENDING THEIR RIGHTS TO ASSETS IN RUSSIA
Cabinet of Ministers has determined the procedure for paying compensation to a foreign holding company during the period of suspension of its corporate rights in relation to an economically significant organisation. 
A decision to pay compensation to be made by such organisation in case of an application from a foreign holding company. Compensation must be paid in the amount of the market value of shares of an economically significant organisation that were not distributed among persons that took direct ownership of the shares.

EXPLANATIONS OF THE MINISTRY OF FINANCE ON PROVIDING INFORMATION ON FOREIGN CURRENCY EARNINGS BY EXPORTERS
A recommended sample schedule for the purchase and sale of foreign currency on the domestic foreign exchange market has appeared on the Ministry of Finance website. 
A schedule to be drawn up for each legal entity subject to the Decree of the President of the Russian Federation on the mandatory sale of foreign currency by some Russian exporters, even if the planned purchase/sale volume is zero. The procedure for the formation and submission of the schedule, as well as the providing of information on planned changes in assets and liabilities, is cleared up.

YOU CAN OBTAIN AN EXTRACT FROM THE REGISTER OF NOTARIES AND PERSONS WHO HAVE PASSED THE QUALIFICATION EXAM THROUGH THE GOVERNMENT SERVICES PORTAL
Using the government services portal, citizens and organisations will be able to contact the Ministry of Justice to obtain an extract from the register without having to visit the department and get the following information:
- on notaries carrying out professional activities on the territory of the Russian Federation, and persons temporarily replacing them;
- about persons who have passed the qualification exam.
This information may be needed to confirm the authority of the person who notarised the document, or the person to whom a citizen or representative of an organisation plans to contact.

LAW ON THE DEVELOPMENT OF TECHNOLOGY COMPANIES IN RUSSIA CAME INTO FORCE
On November 3, 2023, the law came into force that defines the legal framework for activities of technology companies in the Russian Federation, aiming at their state support. 
The law defines forms of support for technology companies: tax benefits, insurance premiums, and customs duties; information, consulting and financial support, export support, creating demand for innovative and (or) high-tech products (works, services). It is planned to extend the program of preferential lending to high-tech, innovative small and medium-sized businesses

RUSSIA HAS RATIFIED THE AGREEMENT WITH THE REPUBLIC OF BELARUS ON MUTUAL RECOGNITION AND ENFORCEMENT OF DECISIONS IN CASES OF TRAFFIC VIOLATIONS
The ratification law comes into force on November 13.
The mechanism provided for by the Agreement involves sending decisions in cases of administrative offences for execution to the party in which the violator who is an individual - is permanently or temporarily residing or an organisation brought to administrative liability is registered.

BANK OF RUSSIA RAISES KEY RATE ONCE AGAIN TO 15% PER ANNUM
On October 27, 2023, the Bank of Russia decided to increase the key rate from 13% to 15% per annum. It has also adjusted an expecting forecast of inflation up to 7 to 7.5 percent, by the end of 2023. Given current monetary policy, inflation range to return to 4-4.5% in 2024.

AGRICULTURAL EXPORT UNDER A SPECIAL PAYMENT PROCEDURE - THE LIST OF PRODUCTS IS ENDORSED
From November 1, 2023, a special procedure applies for settlements under contracts for export of Russian agricultural products concluded at exchange. The Russian Government approved a range of agricultural goods which can be exported with settlement in roubles.
When making payments for supplies, special rouble and foreign currency accounts of type “Z” to will be used, opened in authorised banks by foreign buyers. The list of products includes pork, poultry, wheat, barley, corn, sunflower oil, white sugar, etc.

GOVERNMENT DETAILED THE ISSUES OF MANDATORY SALE OF CURRENCY
The RF President determined the list of Russian exporters for whom mandatory sales of foreign currency are provided. 
It has been established that it concerns crediting at least 80% of the currency to accounts in authorised banks starting from October 16, 2023. One will need to sell at least 90% of the credited amount. The terms of enrolment and sale have been determined. 
It will be possible to request permission not to sell foreign currency in the amount allocated to satisfy requirements denominated in foreign currency from the Government Commission for the Control of Foreign Investments.

GOVERNMENT’S POWERS TO BE PARTLY DEVOLVED ON FEDERAL EXECUTIVE AUTHORITIES STARTING FROM 2024
The law transfers a number of powers of the Government to federal executive authorities in various areas (economy, healthcare, environmental protection, education, culture, etc.). 
From January 1, 2024, certain powers of the Government to adopt normative or other legal acts will be transferred to the Ministry of Health, the Ministry of Agriculture, the Ministry of Culture, the Ministry of Labour, the Ministry of Economic Development, the Federal Railway Transport Agency, the Ministry of Transport, the Central Bank.

FOREIGN CURRENCY FROM THE ACCOUNTS OF ORGANISATIONS OR INDIVIDUAL ENTREPRENEURS TO PAY TRAVEL EXPENSES
To pay for travel expenses, legal entities or individual entrepreneurs who are residents can receive cash US dollars, euros, pounds sterling and Japanese yens from accounts based on payment standards established by law for six months from September 9, 2023. 
There is no maximum limit for issuing the specified currency. There is also no provision for agreement with the Bank of Russia on increasing the limit amount.

EAEU DECIDED TO INTRODUCE LABELLING OF SMARTPHONES AND LAPTOPS
The issues of marking telephone sets and portable computing machines weighing no more than 10 kg, consisting of at least a central data processing unit, keyboard and display, have been resolved. A list of such goods has been determined. In particular, it includes smartphones, laptops. The characteristics of the means of identifying goods, the minimum composition of information about the labelled product, etc., are indicated.

BANK OF RUSSIA AND MINISTRY OF INTERNAL AFFAIRS LAUNCH ONLINE EXCHANGE OF INFORMATION ON FRAUDULENT TRANSACTIONS
On October 21, 2023, amendments to the Law on Banks and Banking Activities and the Law on the National Payment System, adopted last autumn, came into force. The amendments provide for the transfer of information included in the database by the Bank of Russia to the Ministry of Internal Affairs on cases and attempts to transfer funds without the client’s consent, based on information received from the Ministry of Internal Affairs about illegal actions committed.

WHAT WILL CHANGE IN THE DECLARATION OF CORPORATE PROPERTY TAX FROM 2024?
It is explained what changes need to be taken into account when submitting a property tax return for organisations in 2024.
To eliminate surplus reporting and errors in its preparation, which affect the distribution of tax paid in the budget system, changes have been made to this procedure since 2024.
Firstly, the deadline for submitting a declaration has been moved from March 25 to February 25 of the year following the current one. Thus, the obligation to pay tax no later than February 28 will follow the submission of the declaration. In this regard, it will no longer be necessary to additionally submit a notification about the calculated amount of tax indicated in the declaration.
Secondly, the deadline for possible sending a notification on the method of submitting a tax return to the tax authority of a constituent entity of the Russian Federation has been postponed from March 1 to February 1.

It may be used when purchasing a number of goods, to check their authenticity, including specific details, like where, when and who produced the goods, and also information on the goods weight and/or volume. 
Currently the list of goods subject to labelling includes medicines, dietary supplements, dairy products, potable water, beer, tobacco, shoes, fur coats, consumer industry goods, cameras and flash lamps, perfumes and eau de toilette, antiseptics, tires, medical products and wheelchairs. The list is subject to further expanding.

MINIMUM AMOUNT OF VOLUNTARY CONTRIBUTION OF FOREIGN COMPANIES LEAVING RUSSIA HAS FOREIGN INVESTMENT IN FISHERIES - SUBJECT TO SPECIAL CONTROL
In order to strengthen control over foreign investment in fisheries, the Government has adjusted the following:
- rules for forced termination of the right to extract aquatic biological resources;
- procedure for drawing up, issuance, registration, clarification, suspension and cancellation of permits for the extraction of aquatic biological resources.
In particular, a ban has been introduced on issuing fishing permits to Russian companies in which more than 35% of the rights to extract water resources belong to the foreign investors who control them.

MINIMUM AMOUNT OF VOLUNTARY CONTRIBUTION OF FOREIGN COMPANIES LEAVING RUSSIA HAS BEEN INCREASED
The conditions for taking decisions on issuing permits for the alienation of assets of Russian companies by foreign persons from unfriendly countries have been revised. 
Now transactions (operations) aimed at the alienation of securities by specified persons must be carried out, inter alia, subject to a voluntary contribution to the federal budget in the amount of at least 15% of the market value of the relevant assets. Such a fee must be paid within a month from the date of implementation (execution) of the transaction (operation). The market value of assets shall be determined according to an independent appraisal report conducted by a private appraiser who is one of the recommended appraisal organisations.

EAEU HAS ESTABLISHED A LIST OF ELECTRONIC SERVICES FOR VAT PURPOSES
The EEC Council approved a list of services in electronic form for VAT purposes. It consists of 14 services that cannot be provided without the use of information technology. When purchasing an electronic service cross-border on the territory of the EAEU, VAT will be assessed at the location of the buyer.

NEW SECURITY COUNCIL COMMISSION CREATED TO COMBAT THREATS TO BIOLOGICAL SECURITY
An interdepartmental Commission under the Security Council to be formed in order to counter modern threats to biological security. At the same time, the Security Council commission on the creation of a national system of protection against new infections to be abolished. 
The new Commission to assess, among other things, threats to biosafety and the level of protection of the population against the effects of hazardous biological factors. Monitoring compliance with biosafety requirements when implementation of programs and projects and organisation of scientific research and development in the sphere of biotechnology are also numbered as aims of the Commission.

WHEN FILING ELECTRONIC DOCUMENT VIA PUBLIC SERVICES APP IS POSSIBLE, INSTEAD OF A PAPER ONE?
Currently, among documents to be presented using the Public Services app a draft bill envisages only the passport of a citizen of the Russian Federation. 
At the first stage, it will be possible to confirm citizen’s identity using Public Services in the following circumstances:

- in a cinema or museum - when entering an event with an age restriction;

THE CENTRAL BANK OF THE RUSSIAN FEDERATION REMINDED BANKS OF THE NEED TO INFORM BORROWERS ABOUT THE POSSIBILITY OF INSURING THEMSELVES WITH ANY COMPANY
The Bank of Russia and the Federal Antimonopoly Service draw the attention of credit institutions to the need to bring internal documents regulating the procedure for insuring the risks of borrowers of a credit institution, including potential borrowers who are legal entities or individuals, in accordance with Decision of the Government of the Russian Federation No. 39 of January 18, 2023 on the Cases When Agreements Between Credit Institutions and Insurance Agencies Are Admissible, As Well As Foreign Insurance Organisations ..., entered into force on September 1, 2023, and also to place the necessary information on the websites.
It is noted that when applying for a loan, an individual has the right to purchase insurance from any company that meets the bank’s requirements. The lender is obliged to inform the client about this possibility and cannot impose the services of a specific organisation.

On October 1, 2023, amendments to Part One of the Civil Code of the Russian Federation came into force. The Code’s Chapter 16 "Common Property" has been supplemented with a new Paragraph dedicated to the common property of the owners of immovable things. The Council of the Eurasian Economic Commission extended until April 1, 2024 the increased threshold for duty-free import of goods for personal use into the EAEU.
Thus, goods worth up to one thousand euros and weighing up to 31 kg, delivered by carriers or sent by international mail, as well as imported as luggage by all modes of transport except for air, or on foot, will continue to be duty-free.

RF Government has given the right to organisations publishing consolidated financial statements not to disclose information that stock market participants may not disclose to protect against sanctions. 
Credit institutions that disclose their financial statements with exceptions as part of protection from sanctions receive a similar right. 
This will protect Russian companies from unfriendly actions of foreign states and from the introduction of new sanctions against them and their counterparties.

President signed a decree to equate digital identity documents and other state papers issued by public authorities via ‘Public Services’ mobile app with their paper versions. A draft decision of the Government (ID 01/01/09-23/00141824) on conducting, from October 15, 2023 to December 31, 2024, an experiment to track and trace raw materials used for production of medicines for medical use, medicines for medical use on the territory of the Russian Federation is posted on the web-portal of draft laws & regulations.
The proposed list of traceable medicines and raw materials used for production of medicines for medical use is available.
For participants in the turnover of medicines and raw materials, as well as for e-document workflow operators, participation in the experiment will be voluntary.

E-SIGNATURES: NEW RULES DO NOT AFFECT THE PROCEDURE FOR FILING TAX REPORTS
From September 1, 2023, accredited certification centers no longer issue so-called employee certificates, that is, qualified electronic signature certificates, in which company’s INN or INN of an individual entrepreneur is indicated, on whose behalf the individual acts by proxy. The certificates that have already been issued will be valid until the end of August 2024 (previously planned - until the end of 2023).
Thus, e-signature reform is being completed in Russia. From September 1, 2024, individuals acting under a power of attorney on behalf of a legal entity or individual entrepreneur, must use qualified certificates for individuals in conjunction with a machine-readable power of attorney (MChD) in a single format.
However, nothing changes in the interaction of taxpayers when filing reports, since the last stage of the e-signature reform does not concern the Tax Code of the Russian Federation.

Federal Tax Service informs that users will be able to create machine-readable powers of attorney in a single format for exchange both with governmental agencies and between economic entities. Also in the web-portal, you can check the power of attorney created in third-party services and upload it to the distributed registry of the Federal Tax Service for storage.
Moreover, before downloading the machine-readable powers of attorney in the web-portal, you can clarify whether changes have been made to the power of attorney after signing, as well as check e-signatures for the validity.

New rules for classification of beaches and ski slopes are proposed.

DUE TO UPCOMING REDEMPTION OF THE FOREIGN CURRENCY ISSUE OF EUROBONDS, THE BANK OF RUSSIA WILL ACCELERATE TRANSACTIONS MIRRORING OPERATIONS RELATED TO THE INVESTMENT OF FUNDS FROM THE NATIONAL WELFARE FUND

The Bank of Russia will temporarily accelerate the previously announced operations for mirroring transactions related to the investment of funds from the National Welfare Fund in the first half of 2023. From September 14 to 22, the Central Bank will evenly sell foreign currency on the foreign exchange market with a total volume of 150 billion roubles. Thus, the daily volume of these operations will amount to RUB 21.4 billion during this period instead of 2.3 billion roubles. 

The adjustment is due to the upcoming redemption of the foreign currency issue of Eurobonds on September 16, 2023. The decision taken will help satisfy possible additional demand for currency and reduce volatility in the foreign exchange market during this period.

BANK OF RUSSIA HAS SIGNIFICANTLY INCREASED INSURANCE RATES FOR COMPULSORY MOTOR THIRD PARTY LIABILITY INSURANCE FOR FREIGHT TRANSPORT FROM UNFRIENDLY COUNTRIES

From September 12, the territorial coefficient of the insurance tariff for compulsory motor third party liability (CMTPL) insurance in relation to vehicles of legal entities or individuals that are registered in unfriendly states and are temporarily used in Russia will increase from the current 1.7 to 30. Thus, the cost of an CMTPL policy for owners of such vehicles will increase by more than 17 times. The exception will be motorcycles, mopeds and light quadricycles, as well as cars of individuals. The value of the coefficient (1.7) will not change for them.

AGE LIMIT FOR GRANTING A DEFERMENT FROM CONSCRIPTION FOR MILITARY SERVICE FOR IT SPECIALISTS INCREASED - UP TO 30 YEARS OF AGE

In connection with the increase in the age limit for conscription for military service to age 30 from January 1, 2024, the age limit for granting a deferment from conscription for military service for IT specialists has also been increased to age 30. 

In addition, the procedure for renouncing Russian citizenship has been clarified. Male citizens between the ages of 18 and 30 (and not under 27) must present a military ID card when renouncing Russian citizenship.

INCOME TAX FOR FOREIGN COMPANIES: RULES CHANGE FOR CURRENCY CONVERSION AND TAX CALCULATION
On August 31, 2023, amendments to the Tax Code of the Russian Federation came into force. According to the amendments, amounts of tax calculated by a tax agent on the income of a foreign company must be converted into roubles at the official exchange rate of the Central Bank of the Russian Federation set as of the date of payment of the income to a foreign company, but not as of the date of paying the tax, as it was before. The new rule applies to legal relations arising from January 1, 2023.

HOW WILL THE BASE RATE OF THE ENVIRONMENTAL FEE BE CALCULATED?
On January 1, 2024, the law on improving the extended liability for producers and importers of goods and packaging will come into force.
It was decided to create registers of commodity producers and utilizers. For importers, bank guarantees and a surety agreement from the utilizer from the register have been introduced or payment of an eco-fee upon import of goods.
Differentiation of eco-fee rates has been established depending on the complexity of extracting and processing certain types of goods and packaging. To do this, a methodology for calculating rates with appropriate environmental friendliness coefficients will be developed.

CONDITIONS FOR PAYING DIVIDENDS TO BE MITIGATED FOR FOREIGN INVESTORS IN THE RUSSIAN ECONOMY
The Russian Ministry of Finance in coordination with the Bank of Russia announced liberalization of previously established restrictions related to the payment of dividends to foreigners investing in the Russian economy. 
This decision has already been taken into account by the Subcommittee of the Governmental Commission for Control over Foreign Investments in the Russian Federation. 
It is now possible to issue permits to residents to pay dividends to foreign creditors from unfriendly countries, provided that such creditors made investments in the Russian economy after April 1, 2023 (including the expansion of production volume and development of new technologies). Dividends to be paid in an amount not exceeding the amount of investment (previously - no more than 50% of profit).

UNTIL 2030, LEGAL ENTITIES ARE EXEMPTED FROM THE OBLIGATION TO POST INFORMATION ON LICENSES IN THE FEDERAL RESOURCE
Government of the Russian Federation adopted a decision providing for postponement, until 2030, of the requirement to post information on the Federal Resource on obtaining, reissuing and terminating a licence to carry out a specific type of activity (except for information on licenses to carry out activities related to protection of state secrets). The above requirement will not apply with respect to legal entities recognised as licensees in accordance with Item 6 of Article 3 of the Law on Licensing Certain Types of Activities.

PERSONAL INCOME TAX DEDUCTIONS FROM 2024: MEDICAL ORGANISATIONS WILL PROVIDE INFORMATION ON PAYMENT FOR TREATMENT DIRECTLY TO THE TAX OFFICE
From January 1, 2024, amendments are made to the procedure for providing social tax deductions for personal income tax for medical services.
Thus, it is planned to introduce a unified document confirming the taxpayer's expenses for the medical services provided, replacing all documents confirming the right to a deduction and issued now. KEY RATE INCREASED TO 12% PER ANNUM
The Bank of Russia decided to raise the key rate from 8.5% to 12% per annum from August 15, 2023.

FEDERAL TAX SERVICE NAMED KEY AMENDMENTS TO THE LAW ON DIGITAL SIGNATURES
Until August 31, 2024, qualified certificates for employees of legal entities without providing a machine-readable power of attorney will be effective. 
Foreign digital signatures may be recognized as enhanced based on an agreement between the participants in a cross-border transaction. 
From September 1, 2023, the Certification Center of the Federal Tax Service issues qualified certificates for branches and representative offices of foreign companies.

Roskomnadzor recommends that personal data operators collect and process only the information that is really necessary for rendering services, sales of goods, and other activities. Each category of data should be stored separately. Accumulating data "de bene esse", as well as formation of customer profiles, should be abandoned. 
It is necessary to inform Roskomnadzor in due time of signs and (or) incidents that have resulted (possibly caused) the dissemination of personal data.

INCORPORATION ARRANGEMENT WILL HELP TRANSFER FOREIGN ASSETS TO THE COUNTRY
The amendments will allow the creation of international companies by incorporation in special administrative regions. This will help speed up the transfer to Russia of foreign assets of firms that are now hampered by sanctions. 
Founders of an international company will have to transfer to it business assets worth at least RUB 800 million within a year from the date of its state registration. 
Special Administrative Regions appeared in August 2018 on Russky Island (Primorsky Territory) and Oktyabrsky Island (Kaliningrad Region). The main purpose of their creation is the deoffshorization of foreign holdings that are under the control of Russians who own assets in the Russian Federation.

UPDATES: LIST OF DOMESTIC SOFTWARE PRE-INSTALLED ON SMARTPHONES, TABLETS, COMPUTERS OR TVS
The RF Government has determined the list of Russian programs that are subject to pre-installation on smartphones, tablet and desktop computers, TVs with a digital control unit in 2024. 
Innovations: Dzen is provided as a news aggregator (instead of Mail.ru News). Rutube is instead of OK Live for access to online broadcasts and content posted by users. 
Yandex Browser is additionally included in the list of programs pre-installed on TVs, as well as a number of new audiovisual services.

AMENDMENTS TO LEGISLATION ON SPECIAL ECONOMIC ZONES
Mechanisms for creating and managing special economic zones (SEZs) have been adjusted, and the procedure for obtaining the status of a SEZ resident has been simplified. 
Possibility is provided for liquidating the SEZ if its activities are recognized as ineffective for 5 subsequent years. 
Participation of foreign investors in the management company of the SEZ is limited.

FINANCIAL MARKET ORGANISATIONS SHOULD COORDINATE THE PURCHASE OF FOREIGN SOFTWARE WITH THE BANK OF RUSSIA
Customers that undertake procurement in accordance with Federal Law No. 223-FZ of July 18, 2011 are not entitled to purchase foreign software for significant objects of critical information infrastructure without the consent of an authorised government body in accordance with Decree of the President of the Russian Federation No. 166 of March 30, 2022 on Measures to Attain Technological Independence and Security of Critical Information Infrastructure of the Russian Federation.
The draft Presidential Decree on Amendments to Decree of the President of the Russian Federation No. 166 of March 30, 2022 specifies that organisations operating in the banking sector or other areas of the financial market must coordinate such purchases with the Bank of Russia.

SOCIAL MEDIA OWNERS FACE SEVERE FINES FOR VIOLATING LEGAL OBLIGATIONS
An administrative liability is introduced from September 1, 2023: 
- for non-fulfilment of duties by the owner of the social networking website; 
- for non-compliance by the owner of the social networking website with the instructions of the Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications (Roskomnadzor). 
Individuals or legal entities will be fined for failure to provide data to Roskomnadzor that would identify the owners of not only the news aggregator or audiovisual service but also owners of social networking websites or audio-visual services, and (or) other information necessary to maintain the relevant registers.

DIGITAL ROUBLE: NEW FINANCIAL INSTRUMENT IN THE RUSSIAN PAYMENT SYSTEM
Last week, amendments were endorsed to the Civil Code of the Russian Federation and a number of other legislative acts aimed at creating the basis for introduction of the digital rouble and implementation of non-cash payments in digital roubles. 
It will not be possible to open a deposit and receive a loan in digital roubles, and no interest to be charged on balances in digital wallets.

FEDERAL STATE INFORMATION SYSTEM FOR MONITORING THE ENVIRONMENT TO BE CREATED IN RUSSIA
The State Duma immediately adopted in the second and third readings a law providing for creation in Russia of an integrated information system for monitoring the environment. 
The procedure for creation, operation and development of the FSIS to be determined by the Government. The RF Ministry of Natural Resources will act as a customer, while the Russian Environmental Operator will acts as an operator. Access for posting information will be possible through the Unified identification and authentication system (ESIA).

FROM SEPTEMBER 1, 2023, MECHANISM FOR ANTIMONOPOLY REGULATION OF MARKETPLACES IS INTRODUCED
The amendments concern the activities of online trading aggregators. 
It was decided to consolidate the concept of "network effect". This is a property of the commodity market (commodity markets), in which the consumer value of a digital platform that ensures transactions between sellers and buyers changes depending on the change in the number of such sellers or buyers. 
The criteria for the dominant position of such business entities are determined.

The digital rouble is classified as non-cash money. Payments can be made, among other things, by settlements in digital roubles on the territory of Russia. The Bank of Russia transfers them within a special platform. 
Forms of payments in digital roubles will be established by the legislation on the national payment system.

OBLIGATORY AUDIT IS NO MORE NECESSARY FOR ACCOUNTING RECORDS OF INVESTMENT ADVISERS
Starting from the reporting for 2022, the mandatory audit to be cancelled for the accounting (financial) statements of investment advisors engaged in investment consulting only, as well as combining such activity with any other activity that is not subject to licensing. 
Mandatory audit is still necessary if the reporting is exempted from it on one of the grounds provided for by the law, but is subject to mandatory audit on another basis.

LIST OF CHECKPOINTS FOR ENTRY/EXIT OF FOREIGNERS ON A SINGLE ELECTRONIC VISA HAS BEEN EXPANDED
The Government of the Russian Federation has supplemented the list of checkpoints across the state border for the entry and exit of foreigners on the basis of a single electronic visa. The automobile checkpoints Solovyovsk and Starotsurukhaituysky, the railway checkpoints Zabaikalsk and Naushki, the sea checkpoints Magadan and Nikolaevsk-on-Amur, the mixed checkpoints Amurzet and Pokrovka are included in the list.

GENDER REASSIGNMENT IS NOW PROHIBITED IN RUSSIA
Medical interventions, including the use of drugs aimed at gender reassignment, are prohibited. 
An exception to be made for treatment of congenital anomalies, genetic and endocrine diseases associated with impaired formation of the genital organs (for children). It may be allowed only under a decision of the medical commission of the medical institution subordinate to the RF Ministry of Public Health.

The Bank of Russia has developed draft rules for the operating of the digital rouble platform. The types of digital wallets (digital rouble accounts), the procedure for opening and closing them, the list of operations with digital roubles are determined. 
A balancing mechanism is provided for resolving disputes, considering users’ requests and claims, as well as the procedure for monitoring compliance by participants with the rules.

INSTRUCTIONS: SWITCHING KEY ECONOMIC SECTORS TO DOMESTIC DIGITAL PRODUCTS
In 2023, more than 11 billion roubles to be additionally allocated for implementation of roadmaps for development of high-tech areas "New Industrial Software" and "New General System Software". 
The Ministry of Finance, the Ministry of Economic Development and the Ministry of Digital Development, in coordination with the Bank of Russia, are instructed to draw up a road map by the end of September, to develop venture financing for Russian IT companies and stimulate the creation of private industry venture funds, including through providing tax incentives. 
Up to September 1, 2023, lists of standard industrial critical information infrastructure facilities should be formed, where foreign products must be replaced with domestic ones.

TERMS FOR THE WITHDRAWAL OF COMPANIES FROM UNFRIENDLY COUNTRIES FROM RUSSIA AND THE PAYMENT OF DIVIDENDS TO FOREIGN SHAREHOLDERS HAVE BEEN UPDATED
The terms for taking decisions on the issuance of permits for the alienation of the assets of Russian companies by foreign persons from unfriendly countries have been revised. Among the new ones are the repurchase of an asset at market value as of the date of exercise of such an option, the existence of an economic benefit for the resident owner of the asset and the limitation of the period of validity of the permit (as a rule, no more than two years from the date of the implementation (execution) of the initial transaction (operation)). 
The terms for issuing permits for the payment of profits (dividends) to foreign creditors have also been updated in cases established by decrees of the President of the Russian Federation.

FROM JUNE 29, A TRADEMARK CAN BE REGISTERED, INCLUDING IN THE NAME OF A CITIZEN WHO IS NOT AN INDIVIDUAL ENTREPRENEUR
This is due to the entry into force of the amendments to the Civil Code of the Russian Federation, adopted last summer, which removed from the Code the provisions that individuals can act as trademark owners only if they have the status of an individual entrepreneur.

BAN ON OIL SUPPLIES UNDER CONTRACTS PROVIDING FOR A ‘PRICE CEILING’ HAS BEEN EXTENDED
Until the end of 2023, the ban on the supply of Russian oil and oil products to foreign persons is extended if the contract for such supplies involves the use of a price cap mechanism. 
The ban was introduced in response to the establishment of a "price ceiling" for Russian oil and oil products by unfriendly countries. It does not apply to the supply of Russian oil under contracts in pursuance of international agreements with friendly countries.

ROSKOMNADZOR HAS EXPANDED THE LIST OF FOREIGN HOSTING PROVIDERS SUBJECT TO ‘LANDING’
Roskomnadzor included 12 foreign hosting providers into the list of companies subject to "landing".
Including into this list imposes on foreign hosting providers the obligation to open a branch, representative office or Russian legal entity in Russia, post an electronic feedback form with Russian users on their website, register a personal account on the Roskomnadzor website for prompt interaction with authorities.

THE STRATEGY FOR THE DEVELOPMENT OF THE PHARMACEUTICAL INDUSTRY OF THE RUSSIAN FEDERATION WAS APPROVED
 
The Government of the Russian Federation approved the Strategy for the Development of the Pharmaceutical Industry of the Russian Federation for the period until the end of the coming decade.

ADMINISTRATIVE LIABILITY TO BE INTRODUCED FOR THE ILLEGAL USE OF FOREIGN MESSENGERS FOR TRANSFER OF PERSONAL AND FINANCIAL INFORMATION

Changes correspond to the amendments to the Law on Information that came into force on March 1, 2023. It is forbidden to transfer payment documents and details, data on non-cash money transfers, personal data of Russian citizens and information on their bank accounts (deposits) through foreign messengers in the following cases: 

- when providing state or municipal services, fulfilling a state or municipal task; 
- when selling goods, works, services and property rights by state-owned companies, state and municipal unitary enterprises, public companies, business entities in the authorised capital of which the share of the state or municipality exceeds 50%, credit and non-credit financial organisations, as well as subjects of the national payment system.

Russia fulfills its debt obligations under Eurobonds in roubles at the internal rate. 

The RF Ministry of Finance has changed the procedure for settlements. The changes concern activities of NCO JSC NSD to transfer funds to holders of Eurobonds of the Russian Federation.

TEMPORARY RESTRICTION ON THE IMPORT OF OZONE-DEPLETING SUBSTANCES IN 2023

From August 1 to December 31, 2023, a quantitative restriction is established with respect to import into the Russian Federation of ozone-depleting substances of group I of list C, section 2.1 of the List of goods in respect of which a permitting procedure for import onto the customs territory of the EAEU and export is established. The volume allowed for import will be distributed among the applicants that filed applications with the Ministry of Natural Resources of the Russian Federation on the need for the import of ozone-depleting substances, with indicating the purposes for use thereof.

LIABILITY OF TAXI OWNERS TO PASSENGERS TO BE INSURED UNDER THE LAW ON THE COMPULSORY INSURANCE OF CARRIER’S CIVIL LIABILITY

Amendments have been made to the legislation, according to which, starting from September 1, 2024, legal relations concerning the compulsory insurance of civil liability of persons carrying out transportation of passenger in taxi, for harm caused to the life, health or property of such passengers, will be regulated by the OSGOP Law (abbreviation for the Law on the Compulsory Insurance of Carrier’s Civil Liability). Currently, insurance compensations for taxi passengers are paid in accordance with the OSAGO legislation.

CHILDREN WILL BE ALLOWED TO PARTICIPATE IN PHYSICAL EDUCATION ONLY ON THE BASIS OF A MEDICAL REPORT

A law has been adopted regarding the protection of children's health in educational institutions. In particular, it is established that students are allowed to participate in physical education classes provided the statement of a medical organisation issued on the basis of results of preventive medical examinations. 

Moreover, an educational institution should provide first aid to students during their stay in such institution. Such assistance may be provided by teachers or other persons with appropriate training and (or) skills.

Administrative liability is being introduced:

- for distributing online advertising without an advertising identifier or for violating the requirements for its placement; 
- for failure to transfer information about online advertising to the Federal Service for Supervision of Communications, Information Technology, and Mass Media by the advertising data operator, non-compliance with the interaction procedure, violation of the requirements for the advertising identifier.

The Ministry of Finance has developed the Federal Accounting Standard for Accounting (Financial) Statements. It will establish the composition and content of accounting, samples of accounting forms, as well as the terms for its reliability. 

The standard is planned to be applied from the reporting for 2025.

FROM JULY 1, 2023, THE PROCEDURE FOR PLACING INFORMATION AND DOCUMENTS IN THE REGISTER OF CONTRACTS PROVIDED FOR BY LAW NO. 44-FZ WILL CHANGE

From July 1, 2023, the provisions of the Rules for maintaining the register of contracts concluded by customers come into force, providing, among other things, for the obligation of the customer to send, for inclusion in the register of contracts, information about the place of delivery of the purchased goods, the place of performance of work or the provision of services, the address of the web page on which court decision to terminate contract. Also, from this date, information about the counterparty included in the unified register of procurement participants will be placed in the register of contracts automatically if the contract was concluded using the Unified Information System.

A NEW PROCEDURE FOR THE IMPORT OF MEDICAL PRODUCTS INTO THE RUSSIAN FEDERATION FOR THE PURPOSE OF THEIR STATE REGISTRATION HAS BEEN ADOPTED

The Ministry of Public Health approved a new procedure for the import of medical devices into the territory of the Russian Federation for the purposes of state registration, including in order to amend the documents contained in the registration dossier for a medical device, as well as medical products requiring technical tests, toxicological studies, clinical trials, and tests for the purpose of approval of the type of measuring instruments. The new procedure will replace the similar one of 2020 and will be applied until September 2029.

EUROPEAN PROTOCOL LIMIT WITHOUT PHOTOGRAPHIC FIXATION IS PROPOSED TO BE INCREASED

A draft law has been submitted to the State Duma, which provides for an increase the maximum amount of insurance compensation paid in accordance with the European Protocol from 100,000 to 200,000 roubles, in cases where an accident is registered by drivers without using a mobile application that provides photographic recording of the incident picture, and without a technical means of control based on GLONASS.

FROM JULY 1, 2023, THE PROCEDURE FOR REMOVING A SMALL AND MEDIUM-SIZED BUSINESS ENTITY FROM THE UNIFIED STATE REGISTER OF LEGAL ENTITIES IS SIMPLIFIED

Simplified procedure for removing of a small and medium-sized business entity from the Unified State Register of Legal Entities in the event that its founders (participants) take a unanimous decision to terminate the activities of such a legal entity. Information about the upcoming exclusion shall be entered into the Unified State Register of Legal Entities and posted on the website of the registration authority. The simplified procedure is applied under the simultaneous observance of a number of conditions. 

The decision on the upcoming exclusion must be published in the press, which contains data on the state registration of a legal entity. Objections to the upcoming exclusion can be sent to the registration authority within three months. Creditors and other persons may appeal the exclusion of a small and medium-sized business entity from the Unified State Register of Legal Entities within a year from the day they learned or should have learned about the violation of their rights.

THE CONSENT OF THE GUARDIANSHIP AUTHORITIES IS NO LONGER NECESSARY FOR THE EMPLOYMENT OF ADOLESCENTS

Amendments have been made to the Labour Code of the Russian Federation on the issues of employment of minors. 

So, to conclude an employment contract with a teenager who has reached the age of 14, the consent of bodies of trusteeship and guardianship is no longer required. It is enough to obtain the written consent of one of the parents (guardian). 
Employment of orphans and children left without parental care who have reached the age of 14 is possible with the written consent of the bodies of trusteeship and guardianship or other legal representative. These persons may be involved in restricted work that does not harm their health.

CONTRACTS OF PERSONAL INSURANCE WILL CEASE TO BE PUBLIC

The provision according to which a personal insurance contract is a public contract has been excluded from the RF Civil Code. 

Developers of these amendments explained that the amendments are related to fact that conditions under which personal insurance is carried out are individual, since they naturally depend on details of an insured person (age, state of health, etc.). In this regard, such relations do not fit into the structure of a public contract, which, as a general rule, implies the obligation of an economic entity to sell goods, works and services to any interested parties on equal terms (Article 426 of the Civil Code of the Russian Federation).

REQUIREMENTS FOR OPENING TYPE ‘C’ BANK ACCOUNTS (TRUST MANAGEMENT)
Until the end of 2023, requirements are valid for activities of professional participants in the securities market in terms of opening type "C" trust management bank accounts and type "C" trust management depo accounts.
A managing director must open type "C" depo accounts in his own name to record rights to securities under securities management agreements concluded with non-resident clients, except for non-residents that are not foreign creditors from unfriendly countries.
The manager must open bank accounts of type "C" in his name to account for money received to fulfill obligations to foreign creditors from unfriendly countries in the amount of more than 10 million roubles per month or a similar amount in a foreign currency equivalent.

BANK OF RUSSIA CLARIFIED THE MODE OF ‘S’ TYPE ACCOUNTS
The mode of the ‘S’ type bank account of trust management is defined. It is allowed to credit, in particular, funds from residents on operations (transactions) authorised by a subcommittee of the Government Commission for the Control of Foreign Investments. 
It is also established that S type accounts (except for a depo account and sub-depo account) may be credited with refundable amounts of taxes, duties, fees or other mandatory payments payable in accordance with budget legislation.

THE FEDERAL FINANCIAL MONITORING SERVICE WILL CAPTURE LEASEBACK TRANSACTIONS WITH INDIVIDUALS
Mandatory control of operations for the provision of property under a financial lease agreement to an individual is introduced, under which this individual acts as a seller of property that is the subject of leasing. This rule will apply to transactions in an amount of 100 thousand roubles up to 1 million roubles.
The introduced innovation is aimed at reducing the risks associated with the implementation of illegal consumer lending to individuals using the leaseback model.

Disinfection, disinsection and deratization in order to ensure the sanitary and epidemiological well-being of the population will become licensed activities from March 1, 2024. The Federal Service for the Oversight of Consumer Protection and Welfare will issue licences.
Organisations and individual entrepreneurs engaged in the provision of the listed services in order to ensure the sanitary and epidemiological welfare of the population are required to obtain a licence for this activity no later than September 1, 2024.

UPDATES IN THE LIST OF MALFUNCTIONS THAT PREVENT OPERATION OF MOTOR VEHICLES
The updated list is significantly wider than the current one. So, for example, the new edition includes a malfunction of the anti-lock braking system provided by the vehicle manufacturer. The List also includes an item prohibiting the application of coatings on glass that create a mirror effect, with the exception of rear windows, unless this is provided by the manufacturer. In addition, the List included the use of tires with anti-skid studs on vehicles in the summer (June, July, August), as well as the absence of winter tires on a vehicle of categories M1 or N1 in the winter (December, January, February) or the presence of winter tires, tires with anti-skid studs (if used) not on all wheels. The new edition of the List will come into force on September 1, 2023.

RF GOVERNMENT APPROVED THE CONCEPT OF TECHNOLOGICAL DEVELOPMENT FOR THE PERIOD UP TO 2030

A registry model for rendering public services for accreditation of educational institutions has been established. Other changes in the procedure for state accreditation are not envisaged.

AN EXPERIMENT ON THE LABELLING OF SOFT DRINKS AND JUICES STARTS
From June 1 until the end of summer 2023, Russia will conduct an experiment on labelling certain types of soft drinks and juices. The list of drinks subject to labelling includes mineral and carbonated waters with added sugar, kvass, juices, compotes, fruit drinks, soy-based drinks, etc. 
Manufacturers, importers, sellers and catering organisations participate in the experiment on a voluntary basis.

FROM JUNE 1, 2023, RUSSIAN ‘GREEN CARDS’ WILL NO LONGER BE VALID IN THE EUROPEAN UNION
From June 1, 2023, the Bilateral Agreements concluded by the Russian Union of Motor Vehicle Insurers with the bureaus and unions of motor vehicle insurers of the member states of the European Economic Area, as well as Switzerland and the United Kingdom, the provisions of which provide for the mutual recognition of Green Card insurance certificates, are terminated. 
For trips to other countries of the system, including Azerbaijan, Belarus, Moldova, Serbia and Turkey, Russian Green Cards are valid without restrictions. 
To travel within the EU, Switzerland and the UK after May 31, 2023 with vehicles registered in Russia, drivers should purchase a cross-border insurance policy of the corresponding country at checkpoints.

It is clarified that confirmation of compliance of a licence applicant and a licensee with the requirements of the rules of good manufacturing practice of the EAEU should be carried out within the framework of licensing the manufacturing of medicines, including when making changes to the register of licences. 
The requirement concerning an enhanced qualified digital signature when sending an application for a licence to the licensing authority has been eliminated.

Since May 25, the federal state information system of information of a sanitary and epidemiological nature now also includes the values of biochemical studies and a general analysis of human blood (anonymised data). THE PRESIDENT INTRODUCED VISA-FREE ENTRY TO RUSSIA FOR CITIZENS OF GEORGIA AND LIFTED THE BAN ON FLIGHTS TO GEORGIA
From May 15, 2023, a visa-free procedure for entering Russia and leaving the country is introduced for Georgian citizens. An exception is provided for labour migrants, as well as for those entering for a period of more than 90 days (including students). 
The ban on air transportation of citizens from Russia to Georgia, introduced on July 8, 2019, has also been lifted. This ban also applied to commercial flights.

A CHATBOT HAS BEEN LAUNCHED FOR IT COMPANIES THAT ALLOWS TO CHECK THE TRANSFER OF CONSENT TO DISCLOSE TAX SECRETS TO THE FEDERAL TAX SERVICE
Until June 1, 2023, IT companies must confirm state accreditation (a special form for applying is already open on the Portal of Government Services).
As the department has repeatedly reminded, only IT companies that have submitted consent to the disclosure of tax secrets to the Federal Tax Service can retain state accreditation. Without this, it is impossible to confirm that the company meets the conditions for accreditation or receives benefits and is exempt from confirmation of accreditation.
For the convenience of IT companies, the Ministry for Digital Development, Communications and Mass Media has launched a special chatbot, with the help of which, by specifying the INN of the organisation, the transfer of consent to the Federal Tax Service for the disclosure of information classified as a tax secret, can be checked.

THE PRESIDENT SIGNED A DECREE ON A PILOT PROJECT TO CHANGE THE LEVELS OF VOCATIONAL EDUCATION
The experiment will be hold in 2023/24 and 2025/26 academic years at six Russian universities. 
It provides for two levels of higher education (basic, and specialised), as well as one level of professional education (postgraduate studies). 
At the level of specialised higher education, master's, residency and assistantship internship programs will be implemented. 
The term for mastering basic higher education programs will be from 4 to 6 years, but for master's programs from one to three years.

A two-stage verification of compliance with the requirement of unity of invention to be introduced - before and after the information search on the application, as well as new rules for combining inventions into a group. The innovations will make it much easier to obtain legal protection abroad through international and regional registration systems.

ADMINISTRATIVE LIABILITY FOR THE ILLEGAL PROVISION OF INFORMATION FROM THE UNIFIED STATE REGISTER OF IMMOVABLE PROPERTY HAS BEEN ESTABLISHED
The Code of Administrative Offences is supplemented with provisions providing for liability for the following violations of the legislation on state registration of real estate:
- provision of information contained in the Unified State Register of Immovable Property to third parties for a fee by officials of state or municipal bodies, by organisations or citizens;
- creation of websites and computer programs (including mobile applications), through which access to information resources is provided and the possibility of providing information contained in the Unified State Register of Immovable Property is provided;
- the use of such sites in order to provide such information to interested parties.

LIST OF PERSONS SUBJECT TO MANDATORY GENOMIC REGISTRATION HAS BEEN EXPANDED
In accordance with the amendments that entered into force on May 8, persons suspected and accused of committing crimes are among the persons in respect of whom mandatory state genomic registration is carried out (selection and registration of samples of human biological material containing DNA), as well as all convicts serving a sentence of imprisonment.
Previously, such registration, in addition to some other cases provided for by law, was subject to persons serving deprivation of liberty for committing grave or especially grave crimes, as well as persons suspected for sexual offences.

THE CENTRAL BANK OF THE RUSSIAN FEDERATION HAS KEPT THE KEY RATE AT 7.5% PER ANNUM
The Board of Directors of the Bank of Russia decided to keep the key rate at 7.50% per annum. it will be recalled that after a sharp increase to 20% per annum in February 2022, the rate gradually decreased and it is 7.5% per annum from September 19, 2022.

THE PROCEDURE FOR CONTROL OF FOREIGN INVESTORS OVER STRATEGIC BUSINESS ENTITIES HAS BEEN UPDATED
The rules for preliminary approval of transactions and the establishment of control of foreign investors over economic entities that are of strategic importance for ensuring the defence of the country and the security of the state have been adjusted. 
Coordination is provided for when such a business entity obtains a licence for activities of strategic importance, as well as the right to harvest (catch) aquatic biological resources. 
The procedure for coordinating transactions made by foreign investors has been clarified, as a result of which the right to dispose of more than 25% of the total number of votes attributable to voting shares (stocks) that make up the authorised capital of a Russian business entity is acquired, or another opportunity arises to block decisions of the management bodies of such a company.

REGULATIONS ON ACCOUNTING FOR LONG-TERM INVESTMENTS BECOME INVALID ON JANUARY 1, 2024
Starting from January 1, 2024, the Regulations on Accounting for Long-Term Investments become invalid. This is due to the fact that the provisions of the Regulations regarding the accounting of capital investment in fixed assets have actually become invalid since January 1, 2022 due to the entry into force of FSBU 26/2020 "Capital investment".

RUSSIA INTRODUCES A TOTAL BAN ON THE SALE OF VAPES TO MINORS
Advertising is prohibited in terms of demonstration of the consumption of nicotine-containing products using vapes. Their ads should not be shown to children under the age of 12. 
Devices for consuming nicotine-free liquid are classified as nicotine-containing products. Thus, a complete ban is introduced on the sale of vapes to minors - both nicotine-containing and nicotine-free. 
Starting June 1, 2023, retail sales of vapes will only be possible in stores and pavilions.

COUNTER MEASURES PROVIDED IN CASE OF SEIZURE OF RUSSIAN ASSETS ABROAD
If Russia, or Russian legal entities or individuals, are deprived of the right of ownership with respect to property in hostile countries, property rights, or in case of restriction of such rights or the threat of such deprivation (restriction), temporary management to be introduced with respect to the assets of persons from hostile countries. 
A list of assets has been established for which temporary management is being introduced right now. It includes blocks of shares in Unipro PJSC and Fortum PJSC owned by foreign shareholders.

FEDERAL TAX SERVICE LAUNCHES A SERVICE TO CONFIRM THE ZERO VAT RATE
To simplify the confirmation of the zero VAT rate, the so called “Exporter's Office” was put into commercial operation. In order not to submit paper documents, using this service, exporters will be able to quickly create an electronic register, which includes information from the declaration for goods, as well as a list of applications for the import of goods and payment of indirect taxes. From January 1, 2024, the submission of registries only in electronic form by exporters will become mandatory.

VAT REFUND: APPLICATION FOR REFUND SHOULD BE SUBMITTED ACCORDING TO THE GENERAL FORM
From March 26, 2022, the right to a declarative procedure for VAT refunds for the tax periods of 2022 and 2023 should be granted to all taxpayers, unless they are in the process of bankruptcy, reorganisation or liquidation. THE STATE DUMA REJECTED THE DRAFT AMENDMENTS TO THE CODE OF ADMINISTRATIVE OFFENCES OF THE RUSSIAN FEDERATION ON LIABILITY FOR DANGEROUS DRIVING
The amendments provided for the establishment of administrative liability for dangerous driving (in the form of a fine of 5,000 roubles) and the empowerment of officials of the internal affairs bodies with the authority to consider this category of cases.
It was decided to abandon further work on it due to the failure to eliminate comments to the bill for a long time, as well as due to disagreements in the positions of federal government bodies on this initiative.

INDIVIDUALS CAN REPORT THE PRESENCE OF REAL ESTATE AND (OR) VEHICLES THROUGH THE MULTIFUNCTIONAL PUBLIC SERVICES CENTRE
Taxpayers who are individuals are required to report the presence of real estate objects or vehicles recognized as objects of taxation in case of non-receipt of tax notices or non-payment of taxes in respect of these objects for the period of real estate or vehicles ownership.
The Federal Tax Service informs that now such reports can be submitted to the tax authority through a multifunctional public services centre.

FROM APRIL 1, BANK DETAILS ARE PROVIDED ACCORDING TO THE INTERNATIONAL STANDARD
The Bank of Russia recommends that credit institutions use this format when providing clients with their bank details in accordance with the ISO 13616 international standard “International Bank Account Number” (IBAN) for cross-border transactions. Credit institutions can use bank details in this format for cross-border settlements in accordance with the rules adopted in international banking practice.

THE CENTRAL BANK OF THE RUSSIAN FEDERATION STARTS LIMITING MORTGAGE PROGRAMS WITH EXTREMELY LOW RATES
The Bank of Russia announced that it discourages the issuance of mortgage loans, the total cost of which is significantly below the market level. Starting from May 30, 2023, for such loans issued after March 15, 2023, banks must form additional reserves. However, they still have enough room for market rate cuts.
The Information statement notes that recently the so-called "mortgage from the developer" has become widespread with extremely low non-market rates up to 0.1%, which may become achieved by overstating the price of the purchased apartment by 20-30%. In this case, developers pay this margin in the form of a commission to the bank to recompense for shortfall in income. Such programs are at risk for borrowers, banks, and also distort the overall statistics, which ultimately hinders the adoption of informed decisions by all participants. Bank of Russia regulation will limit the spread of such schemes and help mitigate risks.

SIMPLIFICATION OF EMPLOYMENT FOR MINORS: DRAFT LAW ADOPTED IN FIRST READING
The draft law is providing for eliminating the need to obtain the consent of the guardianship and custodianship agencies when employing a person that has reached the age of 14 and has obtained a general education. 
To conclude an employment contract with such person, the consent of one of parents or legal representative will be sufficient. Obtaining the consent of the guardianship and custodianship agencies will be required only for the employment of orphans and children left without parental care.

The Law on the Support of Cinematography has been amended to provide for full state funding for the production and distribution of national feature films for children and youth. 
Decisions on full financing or on subsidizing of national films from the federal budget, the list of which is established by the Law, are taken by the Ministry of Culture of the Russian Federation. The concept of a film for children and youth is fixed. A ban has been introduced on the privatisation of cinematography organisations specialising in showing films not only for children but also for youth.

National Priorities autonomous non-commercial organisation will receive a subsidy for the promotion of consumer non-food products of Russian manufacturers not only on television but also on the Internet. At the same time, only perfumes, cosmetics and household chemicals will be included in such products. The Cabinet of Ministers of the Russian Federation has established that pensions, other payments and provision for compulsory social insurance against industrial accidents and occupational diseases, the payment is currently impossible under the sanctions, may be paid to persons living outside of Russia in the following way: 
- in the currency of the Russian Federation by crediting to accounts in Russian banks; 
- in the currency of the Russian Federation by crediting to bank accounts opened with a foreign bank.

Additional conditions for the issuance of permits for the alienation of the assets of Russian companies by foreign persons from unfriendly countries owned these assets  have been determined. The obligation to obtain information on data processing issues from the authorities of a foreign state, foreign persons to whom a cross-border transfer of personal data is planned, as well as assessing compliance by such foreign persons with confidentiality and ensuring the security of information during their processing, is assigned to the exclusive competence of the operator.

GOVERNMENT ANNOUNCED AN EXPERIMENT ON "AUTO-COORDINATION" OF DRAFT BY-LAWS FROM APRIL 1, 2023
In order to reduce time terms for development and adoption of by-laws, the Cabinet of Ministers has decided to take the next step, and it will be an experiment on the use of the "auto-coordination" principle. This means that if a Ministry or Department violates the terms of consideration, the draft act will automatically be considered agreed and sent to the Government Office. 
The experiment will concern draft government regulations prepared by authorities in pursuance of federal laws. The use of this operating principle is not provided for acts in the field of international cooperation, transport and energy security, and the state defence capability.

EXPLANATIONS FOR DETAILS OF APPLICABILITY OF AGREEMENTS ON AVOIDANCE OF DOUBLE TAXATION
Federal Tax Service has prepared answers to questions regarding: 
- taxation of foreign companies that do not have permanent representative offices in Russia, but obtain income from sources in the Russian Federation; 
- application of agreements on avoidance of double taxation concluded by Russia with foreign states. 
In particular, it is established that return of the principal amount of the debt by a Russian borrower to a foreign lender is not considered as the lender's income from sources in the Russian Federation, since it does not produce economic benefits. 
Agreements do not give tax agents (taxpayers) the choice of the state in which the tax must be paid. Also, they do not establish new tax rates, but only limit the tax rates provided for by the Tax Code of the Russian Federation. If the agreement provides for a higher withholding tax rate than provided for by the Tax Code of the Russian Federation, then the rate established by the Tax Code of the Russian Federation should be applied.

STARTING FROM SEPTEMBER 2023, OWNERS OF TECHNOLOGICAL COMMUNICATION NETWORKS WITH AN AUTONOMOUS SYSTEM NUMBER WILL HAVE NEW RESPONSIBILITIES
Owners of technological communication networks with an autonomous system number are obliged to store the following information for three years on the territory of the Russian Federation: 
- about the facts of reception, transmission, delivery and processing of voice information, text messages, images, sounds, video and other electronic messages; 
- about the interaction of users of information systems and computer programs operating in technological communication networks, and about these users. 
They must also provide state bodies engaged in domestic intelligence activities and security of the Russian Federation with the above and other information necessary to fulfil the tasks assigned to these bodies, in cases established by federal laws.

PROCEDURE FOR ISSUING RUSSIAN VISAS HAS BEEN CLARIFIED
A visa is issued to a foreigner who is in another state than his/her country of nationality, only if he/she has permission to continuously stay in this country for more than 90 days. Another exception to this rule has been established. This requirement may not be met if an ordinary private visa is issued to the specified foreigner who is a close relative of a Russian citizen.

An agreement with Azerbaijan on cooperation in the field of pension provision has been ratified. 
Distribution of financial responsibility is provided for the parties with respect to insurance coverage for pension rights acquired on their territory. This will provide citizens working both in Russia and abroad with the opportunity to exercise their right to pension provision and, if necessary, to summarise the periods of work on the territory of the two states when determining the right to an old-age pension.

One of the principles of state policy is the refusal to impose political strings for the provision of assistance, respect for the right of the recipient states to independently choose a model of socio-economic development, taking into account the characteristics of each of these states.
The list of tasks of state policy has been expanded. Of these, there are the promotion of regional economic integration and the development of trade and economic cooperation with the recipient states, the formation of good-neighbourly relations with neighbouring states, assistance in eliminating the hotbeds of tension and conflicts existing in the territories of these states, as well as preventing their occurrence.

FEDERAL TAX SERVICE HAS UPDATED THE BUSINESS REGISTRATION SERVICE
Now, using the State Online Business Registration service, you can fill in an application not only for registration, but also for the unreliability of the information contained in the Unified State Register of Legal Entities or the objection of an interested person regarding the upcoming registration. 
It became also possible to fill in an application for state registration of a legal entity when creating any organisational-legal form. 
Drawing up and filling in applications for state registration of an international company or an international fund is also available.

BANK OF RUSSIA WILL BE PROVIDED WITH INFORMATION ON ALL PARTICIPANTS IN FRAUDULENT TRANSFERS
It is reported that the Interaction and Response Center of the Information Security Department, established under the Bank of Russia and also known as FinCERT, on whose site all Russian credit institutions exchange information on fraudulent transactions, will be able to obtain additional information from banks on participants in such transfers, and not only about the final recipients of the stolen money. The Federal Tax Service reminds of the ongoing personal income tax declaration campaign.
Taking into account the rule on postponement due to weekends and holidays, it is necessary to submit a declaration on income received in 2022 no later than May 2, 2023.
Income reporting is required if in 2022 the taxpayer, for example, sold real estate that was owned for less than the minimum tenure, received expensive gifts from other than close relatives, won a small amount in the lottery, rented property or received income from foreign sources.

The list of foreign-made goods allowed for import into the country without the consent of the right holders has been adjusted.

THE PRESIDENT HAS SIGNED A DECREE ON ADDITIONAL TEMPORARY MEASURES RELATED TO THE CIRCULATION OF SECURITIES
The Decree provides for a special procedure for making transactions with Russian securities (shares of a Russian joint-stock companies, sovereign bonds, bonds of Russian issuers, the rights to which are centrally recorded by a Russian depositary, investment units of Russian mutual funds), entailing the transfer of the right of ownership to these securities, or their transfer to trust or pledge.

Until February 1, 2024, in Armenia, Belarus, Kazakhstan and Kyrgyzstan, conformity assessment and release into circulation of individual trucks, buses, trolleybuses and cars for the transport of passengers imported for their own needs on the territory of these states are allowed, without equipping with systems (devices) emergency calls.
Previously, this option was valid until February 1, 2023.

FEDERAL SPECIAL STAMPS WITH THE EMBLEM ‘WINE OF RUSSIA’ WILL APPEAR ON RUSSIAN WINES FROM DOMESTIC GRAPES
From March 1, 2023, it is possible to issue federal special stamps with the emblem "Wine of Russia" to members of the Federal Self-Regulatory Organisation of Winegrowers and Winemakers of Russia, who have confirmed the Russian origin of the grapes used to make wine, fortified or sparkling wine.
The emblem "Wine of Russia" will appear on three federal special stamps with the inscriptions "Wines", "Sparkling wines" and "Liquor wines".

OPERATORS MUST REPORT INCIDENTS WITH PERSONAL DATA BASES WITHIN 24 HOURS
A procedure is established for operators to interact with the state system for detecting, preventing and eliminating the consequences of computer attacks on Russian information resources, including informing the Federal Security Service of incidents that resulted in the unlawful data breach. Such interaction shall be carried out through the National Coordination Centre for Computer Incidents. Operators must send information within 24 hours from the moment an incident is discovered.

The Government of the Russian Federation has amended the rules for certification in the following way:
- the list of types of economic activity for certification has been expanded. From now, IT companies that are engaged in research and development in the field of natural and technical sciences may also obtain state accreditation; 
- the criteria that IT companies must meet, as well as the procedure for their confirmation, have been adjusted; 
- the list of companies that are entitled to be certified as IT companies has been expanded.

OIL AND GAS COMPANIES ON YAMAL: ENTITLED TO A TAX CREDIT
On February 16, 2023, the State Duma in the second and third readings approved amendments to the Tax Code of the Russian Federation aimed at providing funding for construction of additional infrastructure for the transportation of liquid hydrocarbons produced on Yamal. 
In particular, it is planned to provide a tax credit through a deduction to be applied for the period from April 1, 2023 to March 31, 2029 with respect to tax on the extraction of minerals (MET-gas & MET-oil), in the amount of 1.111 billion roubles - for acquisition, construction, production and delivery of fixed assets related to the road, transport, engineering and energy infrastructure necessary for implementation of the corresponding project

BOOKING THE DATE AND TIME FOR FREIGHT CARRIERS TO CROSS THE RUSSIAN BORDER AT CERTAIN CHECK-POINTS
The Law on Motor Roads and Road Activities in the Russian Federation provides that the passage of freight vehicles, used for international road transport and owned by Russian or foreign carriers, on sections of motor roads included into a special list, in order to cross the State Border of the Russian Federation, is carried out in a reserved date and time in accordance with the procedure established by the Government of the Russian Federation. This procedure should include a list of cases of out of turn travel and rules for booking date and time - free of charge using the GIS (State Information System)

CONSTITUENT DOCUMENTS OF NON-PROFIT ORGANISATIONS: AMENDMENTS ENTERED INTO FORCE ON MARCH 1, 2023
On March 1, 2023, the December amendments to the Law on Non-Commercial Organisations and the Law on Public Associations come into force.
From March 1, 2023, Article 14 of the Law on Non-Commercial Organisations establishes, as a general rule, that the constituent document of a non-commercial organisation is the charter (the exception is state corporations that operate on the basis of relevant federal laws). It will also be possible to use a model charter as a constituent document (it must be approved by the Ministry of Justice of the Russian Federation).
The requirements for the content of the charter will also be adjusted

The Law on privatisation has been supplemented with a provision stipulating that when privatising a state or municipal-owned premises, which is the only way of passage or access to other premises located in the building, the privatisation transaction must necessarily be accompanied by the establishment of a public easement to ensure passage.
This rule will not apply in cases where passage can be provided through rooms belonging to the common property of the building

From 2023, uniform deadlines for the payment of transport and land taxes, property tax, as well as advance payments on them have been established for legal entities.
So, for the tax period of 2022, these taxes must be paid no later than February 28, 2023. Advance payments on them during 2023 must be paid no later than the 28th day of the month following the expired reporting periods (first quarter, second quarter and third quarter of the calendar year)

The moratorium on inspections of certified IT companies will no longer apply to unscheduled control and supervision activities with respect to such companies in the following cases: 
- distribution on the Internet of databases (or parts thereof) containing personal data; 
- such databases belong to a certified company; 
- unscheduled measures are carried out by Roskomnadzor in accordance with a decision of Roskomnadzor as agreed upon with the Prosecutor's Office

EXPORTERS PARTICIPATING IN DELIVERIES UNDER INTERGOVERNMENTAL CONTRACTS ARE EXEMPTED FROM THE MANDATORY SALE OF FOREIGN EXCHANGE EARNINGS
Russian exporters that supply goods from Russian suppliers abroad in pursuance of intergovernmental contracts are allowed to transfer foreign currency received from non-residents (net of expenses incurred) to suppliers' accounts opened with authorised banks without its obligatory sale. 
However, transfer of funds in a currency another than specified in the supply agreement, without the obligatory sale of currency, is possible only with the prior consent of the supplier. If for the transfer it is necessary to convert a currency into another, the procedure and conditions for the conversion must also be agreed upon with the supplier.

NEW STANDARDS HAVE BEEN INTRODUCED TO ENSURE THE INFORMATION SECURITY OF THE FINANCIAL SECTOR
From February 1, 2023, new state standards are in force, which can be followed by banks, non-credit financial institutions or processing centres to ensure information security. 
Standards contain provisions for defining a risk management policy, measures for its identification, assessment and monitoring. They describe measures to reduce risk, respond to cyber incidents and restore infrastructure, rules for interaction with service providers in the area of information technology, conducting cyber training.

UNSCHEDULED CHECKS OF OPERATORS ARE ALLOWED IN CASE OF LEAKAGE OF PERSONAL DATA
Another exception has been made to the moratorium on inspections introduced by the Government of the Russian Federation. In 2023, the Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications has the right to carry out unscheduled control measures in relation to operators if the fact of distribution (provision) of personal data bases (or parts thereof) on the Internet is established. 
For accredited IT companies, unscheduled inspections on the same basis are allowed in 2023-2024.

LIST OF PERSONS SUBJECT TO MANDATORY STATE GENOME RECORDS IS EXPANDED SIGNIFICANTLY
According to the mentioned amendments, the list of persons subject to mandatory state genome records is expanded. 
From May 8, 2023, “persons convicted and serving sentences of imprisonment for committing crimes”, as well as “suspected and accused of committing crimes” are recognised as subjects to the state genome records, but from 2025, also persons subject to administrative arrest. 
The Law provides for the right to demand the removal of genome information obtained as a result of state genome records, if the right to rehabilitation arises or if a decision on the case of an administrative offence is cancelled.

The Cabinet of Ministers approved the new National Action Strategies for Women for 2023-2030.
The key goals of the strategy are to increase the economic independence and political activity of Russian women, the prevention of women's social problems, and the preservation of the health of women of all ages.
It is supposed to solve the tasks set by creating women's interest in technical or technological specialties, involving women in the digital economy, developing remote forms of employment, creating conditions for women to receive professional education, and improving their skills in the area of economics, providing ample opportunities for employment, including high paying jobs.

On January 24, 2023, the Duma approved, in the first reading, amendments to the Law on Digital Signatures. Participants in the financial market will be allowed to delegate powers using digital signatures. The Certification Centre of the Central Bank will issue verification key certificates to all subjects of the national payment system, to persons and entities that provide services in the financial market, self-regulating organisations operating in the financial market and self-regulating organisations involved in providing services in the financial market.

The procedure for currency export from Russia is the following:
- export in an amount exceeding the equivalent of 10,000 US dollars (at the exchange rate as of the date of export) is temporarily prohibited;
- if the currency of different states is exported simultaneously, each currency should be converted into roubles, and then the total amount should be converted into US dollars;
- the export of roubles and cash in the equivalent of up to 10 thousand US dollars is not limited.
- if roubles are exported along with the foreign currency and the total amount of cash exceeds the equivalent of ten thousand US dollars, then the entire amount is subject to declaring.

The RF Government has regulated the issues of online admission to universities as part of the admission campaign for the 2023/24 academic year. The process of submitting documents for online admission to a university has been simplified: certain details that previously should be finger-tipped will now be uploaded automatically. New state information systems have been additionally connected to the service "Online admission to universities". Among them are the following:
- "Physical Culture and Sports" platform, that is resource containing information on children with outstanding abilities;
- an information system in the field of volunteering activities, etc.
Achievements in these areas allow additional points for entering a university. For example, they may be obtained if the applicant has a GTO badge (Ready-for-labour-and-defence) or won the All-Russian Olympiads.

LARGE COMPANIES OPERATING IN THE AREA OF ENERGY, ENGINEERING OR TRADE CAN TAKE CORPORATE DECISIONS WITHOUT TAKING INTO ACCOUNT THE VOTES OF CO-OWNERS FROM UNFRIENDLY COUNTRIES

Until the end of 2023, votes belonging to persons from unfriendly countries or to persons who are appointed from among the candidates nominated by persons from unfriendly countries may not be taken into account when determining the quorum and voting results on the agenda items. The provisional decision-taking procedure applies to Russian companies that simultaneously meet the following conditions:
- the company operates in the area of energy (including electric power), mechanical engineering or trade;
- the controlling person or beneficial owner is subject to foreign sanctions or restrictions;
- persons of unfriendly countries own no more than 50% of the amount of the authorised capital of the Russian company;
- the total revenue of the Russian company for the year preceding the year the decision was taken exceeds 100 billion roubles.

THE CABINET OF MINISTERS HAS REGULATED THE PROCEDURE FOR PROHIBITING AND RESTRICTING THE TRANSFER OF PERSONAL DATA ABROAD
The procedure for taking a decision to prohibit or restrict the cross-border transfer of personal data by the authorised body, as well as the procedure for informing operators of such a decision has been established. 
The decision to ban or restrict is taken by the Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications based on the submissions received. They can be sent by the Ministry of Defence, the Ministry of Foreign Affairs, the Federal Security Service of the Russian Federation or other authorities authorised by the President or the Government of the Russian Federation to ensure the protection of the economic and financial interests of the country. 
The adopted decision is sent to the authorised body that submitted the submission, as well as to the operator no later than the day following the day of its adoption, by any available method that allows confirming the fact of its receipt.

SOME ISSUES OF NATIONALIZATION OF SAKHALIN ENERGY INVESTMENT COMPANY, LTD. HAVE BEEN CLARIFIED
Earlier, the President ruled out specifying the period for the sale of the unclaimed stock in the nationalized Sakhalin Energy Investment Company, Ltd.. The Government of Russia made the relevant changes to the rules for conducting an audit and the rules for evaluating and selling a share in the authorised capital of the limited liability company Sakhalin Energy.

ON THE EXTENSION OF THE TRANSITIONAL PERIOD FOR A UNIFIED TECHNOLOGY FOR THE EXCHANGE OF MACHINE-READABLE POWERS OF ATTORNEY
Until September 1, 2023, the experiment on testing the unified technology for the exchange of machine-readable powers of attorney carried out by legal entities and individual entrepreneurs through its digital platform based on the distributed blockchain registry has been extended. This will allow even more participants in electronic document management to prepare for working with machine-readable powers of attorney in conjunction with a certified digital signature certificate of their representatives who are individuals. 
The exchange of machine-readable powers of attorney, issued by way of substitution, became available to participants in the unified technology of the Federal Tax Service from December 9, 2022. Blockchain technology algorithms check the chains of substitution and notify the participants of the termination of the machine-readable powers of attorney (their chains) if any of them has been cancelled.

LIBERALISATION OF REQUIREMENTS FOR MIGRANTS FROM THE EAEU
Amendments to the Treaty on the EAEU are ratified. 
The mode of residence and work for labour migrants from the EAEU has been simplified. It provides, inter alia, for recognition of certifying documents for teachers and lawyers, as well as academic degrees and titles. A working migrant will be able to change the purpose of entry without leaving the territory of the state of employment. 
The rules on customs control and the fight against tax evasion are also clarified.

STARTING FROM 2023, A NEW PROCEDURE FOR RECORDING INCOME, EXPENSES AND OTHER COMPREHENSIVE INCOME IN ACCOUNTING ACCOUNTS BY CREDIT INSTITUTIONS WILL BE IN FORCE
The Bank of Russia has updated the procedure for recording income, expenses and other comprehensive income in accounting accounts by credit institutions. This is due, among other things, to the fact that the Statement of Financial Results is included in the Appendix to the Chart of Accounts for Credit Institutions. 
The Regulations entered into force on January 1, 2023.

MARKING ONLINE ADVERTISING: THE REQUIREMENTS FOR THE ADVERTISING IDENTIFIER, THE PROCEDURE AND TERMS FOR ITS ASSIGNMENT AND PLACEMENT HAVE COME INTO FORCE
On September 1, a new article appeared in the Law on Advertising, which establishes the procedure for placing advertising on the Internet in order to ensure its traceability. The provisions of this article, among other things, stipulate that the distribution of advertising on the Internet hall be allowed only if the operator of the advertising data assigns an advertising identifier to the corresponding advertisement - a unique digital designation designed to ensure the traceability of advertising distributed on the Internet and to record information about such advertising.
On the eve of the New Year holidays, the Ministry of Justice registered the Order of the Federal Service for Supervision in the Sphere of Telecom, Information Technologies and Mass Communications, which approved the requirements for an advertising identifier, its content, the procedure and terms for its assignment, placement when advertising is distributed on the Internet, storage and submission to the department. The Order entered into force on January 9, 2023.

AMENDMENTS TO THE CODE OF ADMINISTRATIVE OFFENCES CAME INTO FORCE, PROVIDING FOR THE POSSIBILITY OF AUTOMATICALLY FIXING THE FACT OF ILLEGAL UNLOADING OF GARBAGE FROM VEHICLES
These amendments are the part of global changes to be made into the Code of Administrative Offences of the Russian Federation, adopted last summer. These amendments to the Code introduced special provisions that provide for strengthened administrative responsibility for unloading or dumping waste from motor vehicles and trailers outside specially designated areas. 
Moreover, this law secured the possibility of fixing such offences with the use of technical means operating in automatic mode. The corresponding provisions were adopted with the extended deadline and began to apply from January 11, 2022.

NEW POWERS IN THE FIELD OF CIRCULATION OF MEDICINES AND MEDICAL DEVICES ARE GRANTED TO THE GOVERNMENT
In 2023, the Government of the Russian Federation will be entitled to establish the specifics of circulation of medicines for medical use and medical devices. 
This measure is envisaged as part of the anti-sanction regulation of the Russian economy.

IT IS PLANNED TO ADJUST THE LEGISLATION ON FOREIGN INVESTING INTO STRATEGIC ECONOMIC ENTITIES
On December 21, 2022, the State Duma adopted in the second and third readings amendments to the Laws on Foreign Investments in Strategic Economic Companies in the Field of Defence and Security, on Fisheries, Transport Security, Licensing and also amendments to the Air Code. 
Licensing of strategic activities to be settled for organisations that started their activities after the establishment of foreign investors control. 
Moreover, for companies that are controllable by foreign investors, mandatory preliminary approval of transactions will be introduced with respect to granting rights to harvest certain types of biological resources within the boundaries of the fishery basin in the form of allowable catch volumes (as by quotas types).

AUCTION RULES ARE UPDATED FOR ACQUIRING THE RIGHT TO CONCLUDE A WATER USE AGREEMENT
The Government has established new rules for drawing up and concluding a water use agreement, the right to conclude which is acquired through an auction, as well as the rules for holding such auctions. 
Applications for granting the water area of a water body for use may be submitted through the federal public services web-portal or through a regional web-portal for providing state and municipal services, as well as using departmental information systems.

REGISTRATION OF DECLARATIONS OF PRODUCT CONFORMITY WITH THE TECHNICAL REGULATIONS OF THE EAEU BECOMES FASTER
Declarations and the necessary documents can be submitted to an authorised certification body, including on paper, directly or by courier service. 
The term for registering a declaration has been reduced from 5 to 3 business days.

AN EXPERIMENT WITH DIGITAL MEDICAL MONITORING OF PATIENTS WITH DIABETES OR HYPERTENSION HAS BEGUN IN A NUMBER OF REGIONS
The Government of the Russian Federation has allowed regions to introduce digital remote monitoring of adult patients with both types of diabetes or arterial hypertension: patients will be provided with medical devices that transmit to physicians information on the patient's condition (blood pressure, heart rate, glycaemia); and this information will be processed in the medical decision support system (naturally, using AI technologies, neural networks and other innovations). 
For this purpose, the so-called experimental legal regime has been established in 6 regions (Tatarstan, Samara, Tyumen, Magadan, Novosibirsk and Ryazan regions). 
To ensure such remote monitoring of patients in the Russian Federation, the Personal Medical Assistants information platform has been launched, which will receive, process and store data obtained from patients, as well as transmit the data to specialised information systems.
